KEEPING TAX REFUNDS IN CHAPTER 13.
If you are trying to keep all or part of your tax refunds you must follow these instructions.

1. If your Chapter 13 bankruptcy does not provide for all of your creditors to be paid at 100% then the Chapter 13 Trustee will require that you surrender to their office your Federal tax refund for each year you are in the Chapter 13.
2. We can file a Motion to Retain all or part of the tax refund, but the motion must be have supporting documents attached.
3. The Trustee will review these documents and their office and ours will try to work out how much of the tax refund is needed to pay the documented items.
4. The documents we present are very important.
5. The documents you give us must:
a. Be good quality and readable.
b. Have dates, amount and show what it is for.
c. Be on company letterhead, company invoice, or web site with company name.
d. Have a date that is current.
e. Be a reasonable expense such as medical, auto repair, home appliance, etc...
f. Not be a repeat item from last years motion.
6. If the IRS sends you the tax refund instead of sending it to the Trustee then you must notify our office and you should not cash or deposit the refund check. You must hold the check until we receive an order on our motion.
7. At the end of your case the Trustee will ask to see all tax returns due during your Chapter 13 case. The Trustee's office will look at these tax returns to see if you received a tax refund. If you did receive a tax refund and the refund was not surrendered to the Trustee, or you did not receive a court order approving a motion to keep the refund, the Trustee will move to dismiss your Chapter 13 case.
