 CHAPTER 13 - Pro and Con.
 Pro:
  • You make payments to your 'repayment plan' every month. The bankruptcy court appoints a Chapter 13 Trustee to receive these payments and pay them out to your creditors.
  • Most Chapter 13 cases can be filed for only the $75 upfront. Attorney fees are paid with the creditors each month.
  • Chapter 13 payments are based on the amount of debt that you are paying in the case, and the amount of debt that is being wiped out.
  • Wipes out charge card debt.
  • Wipes out some taxes.
  • Allows you to surrender house and walk away from mortgage.
  • Allows you to surrender other property and walk away from the debt.
  • Stops suits and garnishments.
  • Stops foreclosure.
  • Stops repossession.
  • Stops tax, child support and student loan collection.
  • Repay past due mortgage payments.
  • Repay past due rent to own lease.
  • Repay past due child support.
  • Repay student loans.
  • Repay taxes that are less than 3 years old.

Cons:
  • Repayment Plan can lasts between 36-60 months.
  • May have to surrender part of your tax refunds as payment towards your Chapter 13.
  • Plan will be dismissed if you do not pay into it.
  • Cannot pay a creditor directly except for mortgage, leases, child support and few others.
  • Will not wipe out student loans.

  • Temporarily stops foreclosure.
  • Temporarily stops repossession.
  • Temporarily stops tax and student loan collection.
  • You can continue to pay any creditor if the creditor agrees.
  • You can continue to pay for auto if creditor agrees (reaffirmation).
  • You can continue to pay mortgage without creditor approval - if you are current.

 
Cons:

  • Cannot make auto creditor accept payments, creditor can choose to repo auto instead.
  • Cannot make a creditor return property that has been repossessed before the Ch 7 is filed.
  • Cannot modify 2nd mortgage.
  • Does not protect co-signers.
  • Does not allow you to keep auto unless creditor agrees.
  • Does not allow you to catch up mortgage payments.
  • Will not wipe out taxes less than 3 years old.
  • Will not wipe out student loans.
  • Does not stop child support collection.
